Public consultation for draft regulation of DJID mandatory HS code

Through an official announcement on the e-Sertifikasi page, a draft of ministerial decree for DJID mandatory HS code was published on 7 July 2025. If we throwback to particular sharing session in 2024, the ministry of communication through DJID (formerly SDPPI) has ever been socialized about this regulation. From the sharing session, it was also discovered that the way to determine whether or not one device requires DJID certification can be checked from the device features and/or the device’s HS code. The draft regulation of DJID mandatory HS code is prepared for the purpose of the surveillance process at Indonesia customs.

In this article we will discuss all about draft regulation of DJID mandatory HS code, from the background of the regulation until how we can participate during this public consultation session.

Backgrounds of the regulation of DJID mandatory HS code

During 2024’s sharing session, there are two main reasons why the Ministry of Communication and Digital (formerly KOMINFO) plan to issue the regulation of DJID mandatory HS code.

Enforcement of PERMEN KOMINFO No. 3 year 2024

One of the main reasons why the draft regulation for DJID mandatory HS code needs to be prepared is because the enforcement of the regulation of PERMEN KOMINFO No. 3 year 2024 regarding certification of telecommunications devices in Indonesia. If we look at to the article 33 of the regulation, it stated that the surveillance of telecommunication devices based on the harmonized system code (HS code) will be regulated in a separate ministerial decree.

Therefore, to implement the mandate of the provisions of article 33 of PERMEN KOMINFO No. 3 year 2024 in the context of surveillance activity for telecommunication devices in Indonesia, the Ministry of Communication and Digital has prepared a draft Decree of the Minister of Communication and Digital regarding the list of HS Code of telecommunication devices that mandatory to meet technical standards through DJID certification.

Determination of 2022 Indonesian Customs Tariff Book

Another background to prepare the issuance of regulation of DJID mandatory HS code is the Finance Ministerial Regulation Number 26/PMK.10/2022 regarding the determination of the goods classification system and imposition of import duty tariffs on imported goods which was stipulated on 1 April 2022.

From the regulation of the Minister of Finance, it is known that there are changes for the goods classification system which can be in the form of splitting or combining HS codes. Key points in the Ministerial Decree of DJID mandatory HS code

There are some key points we need to take a note from the draft regulation of the Decree of Minister of Communication and Digital includes:

  • Determination of the list of telecommunication devices, including other devices and/or equipment that have telecommunication features, which must meet technical standards through DJID certification process.
  • The list of telecommunication devices and/or telecommunication equipment and other devices and/or equipment that have telecommunication features is compiled based on the harmonized system code (HS code) in accordance with the provisions of laws and regulations.
  • The inclusion of the harmonized system code (HS code) in this Ministerial Decree is an administrative supervision instrument and is not a reference in determining the harmonized system code (HS code) for types of goods in the customs settlement process.
  • In the event that there are telecommunication devices and/or telecommunication equipment and other devices and/or equipment that have telecommunication features that are not yet listed in the Attachment to this Ministerial Decree, they are still required to meet technical standards through DJID certification process.
  • Supervision of the provision of technical standards by Ministries/Institutions shall be carried out after passing through the customs area.
  • This Draft Ministerial Decree shall come into effect 30 (thirty) calendar days from the date of stipulation.

How to participate in this public consultation?

In accordance with the mandate of Article 46 of Law Number 30 of 2014 regarding Government Administration, which requires government agencies to provide information to stakeholders before making a decision, the Ministry of Communication and Digital intends to disseminate information to all related stakeholders on the Draft Decree of the Minister of Communication and Digital regarding the List of Telecommunication Equipment and/or Telecommunication Devices Required to Meet Technical Standards and invites all related stakeholders to provide responses or input on the Draft Decree.
