The Ministry of Science and Technology or MST (formerly MIC) has published a draft of new Circular regarding the list of products required to do Vietnam type approval and supplier declaration of conformity. Basically, in the draft of the new Circular, there is a list of products that require to meet supplier declaration of conformity requirement only, and also a list of products that require both Vietnam type approval and supplier declaration of conformity. This draft of new Circular will replace the Circular No. 02/2024/TT-BTTTT and estimated to take effect in early 2026.

Key notes of draft new Circular

There are several key points under the draft of new Circular that manufacturers, importers, or suppliers should pay attention to. Here is a summary of the draft new Circular:
- Several technical regulations have been updated, including the addition of technical regulations of QCVN100:2024/BTTTT on Terrestrial Trunked Radio equipment, QCVN133:2024/BTTTT on NR and E-UTRA mobile communication base station equipment, QCVN134:2024/BTTTT on SAR requirements, and QCVN135:2024/BTTTT on surveillance cameras using Internet Protocol.
- Surveillance camera equipment with Internet Protocol has been added to the list of products requiring Vietnam type approval certification.
- Technical regulation QCVN134:2024/BTTTT as a SAR technical standard, will officially be mandatory for mobile computer equipment on 1 July 2026, and also for DECT phones, tablets, and notebooks on 1 July 2027.
- Equipment equipped with Wi-Fi 6E and 7 features operating in the frequency band of 6 GHz is added as a product that requires to meet supplier declaration of conformity requirements. Therefore, equipment equipped with Wi-Fi 6E and 7 features must comply with technical regulations QCVN47:2015/BTTTT and QCVN96:2015/BTTTT for EMC testing. In addition, manufacturers also need to disable frequency operation in the frequency band of 6.425 GHz to 7.125 GHz.
- Technical regulation as a lithium battery requirement will officially be mandatory on 1 January 2026 by the time the new Circular comes into effect. There are already three local Vietnamese labs that recognized for lithium battery testing.
- Exemptions of extreme conditions test requirement refer to several technical regulations QCVNs will be extended until 30 June 2026 only if there is still no local labs in Vietnam that can perform extreme conditions test.
- Radio receiver-only devices are now explicitly exempted from the conformity certification and supplier declaration of conformity requirements.
- Exemptions for certain products are clarified with Decree No. 132/2008/ND-CP and its amendments.
Transitional of draft new Circular
Vietnam type approval for the products specified in this draft of new Circular issued between 15 July 2023 and before the effective date of this new Circular, shall remain valid until the expiration date stated in the certificate of conformity.
Organizations or individuals engaged in production or importation are allowed to complete the dossier for declaration of conformity and register for quality inspection of imported goods during the period from 1 January 2024 until before the effective date of this draft of new Circular, following the regulations regarding technical regulation specified in Circular No. 04/2023/TT-BTTTT dated 31 May 2023, and Circular No. 10/2023/TT-BTTTT dated 5 September 2023, or according to the regulations regarding technical standards specified in this draft of new Circular.
Conclusion
The draft of new Circular is currently in the public consultation phase and has not yet come into effect. It means that manufacturers, importers, or suppliers still have time to provide input before the regulation is officially come into effect. Once finalized, Circular No. 02/2024/TT-BTTTT will be revoked, and the this new Circular will take effect, estimated in early 2026.
