Philippines NTC Publishes Draft of Amendment to Memorandum Circular No. MC 03-05-2007

The National Telecommunications Commission (NTC) of the Philippines has published the draft of amendment to MC 03-05-2007. NTC conducted a public consultation regarding the proposed amendment to MC 03-05-2007, particularly on the allocation of the 77 – 81 GHz frequency band for equipment designed to detect movement and provide alerts, including low-power radar systems intended for radiodetermination purposes. Key Notes of Draft Amendment to MC 03-05-2007

In order to keep pace with developments in wireless technology to ensure wider access to limited radio frequency spectrum and the use of cost-effective technology in the Philippines, Article 2 of Memorandum Circular No. 03-05-2007 is amended.

Referring to the draft amendment, the technical parameter limits set out in the table below must not be exceeded by any function of the equipment or by any means.

Impact on the Philippines Type Approval

Any circular, memorandum or order that does not comply with the provisions of this draft Circular Memorandum will be amended or replaced accordingly. The draft Memorandum Circular shall take effect 15 days following its publication in a newspaper of general circulation. The type approval applications, especially for radar system equipment, may need to comply with this draft Memorandum Circular once implemented.

Currently, NTC is still open the public hearing for the draft amendment to Memorandum Circular No. MC 03-05-2007. Parties may submit their respective comments before 26 May 2026. Comments and inputs can be submitted via email to commissioner@ntc.gov.ph and spectrum@ntc.gov.ph with the subject “Position Paper on Amending Section 2 of NTC Memorandum Circular No. 03-05-2007”.

Conclusion

The implementation of the draft amendment to Memorandum Circular MC 03-05-2007 may affect on the type approval process in the Philippines.
