Brazil ANATEL Reduces WiFi 6 GHz Frequency Band Under Act No. 10.400

The National Telecommunications Agency (ANATEL) of Brazil has published the Act No. 10.400 on 12 August 2026 regarding amendments to the frequency range requirements of WiFi 6 GHz previously established in the Act No. 14.448 dated 4 December 2017. This amendment reduces the available frequency band for WiFi 6 GHz in Brazil from 5925 – 7125 MHz to 5925 – 6425 MHz. The Act No. 10.400 enters into force on the date of its announcement in the Anatel Electronic Service Bulletin, with implementation mandatory starting from 1 March 2027. Therefore, in this article we will discuss all important notes from the Act No. 10.400 and its impact to Type Approval in Brazil.

Key Notes of New Frequency Allocation for WiFi 6 GHz Under Act No. 10.400

The Act No. 10.400 dated 12 August 2026 amends the frequency range requirements for the following types of WiFi devices, which were previously established in Annex I of Act No. 14.448 dated 4 December 2017, these amendments include:

  • Amends the operating frequency band for Client Equipment to 5925 – 6425 MHz, whose transmission is under the control of an Indoor Access Point or a Subordinate Access Point and which does not have the capability to establish a network.
  • Amends the operating frequency band for Very Low Power Equipment to 5925 – 6425 MHz, a portable equipment that may operate in an open-air (outdoor) or enclosed (indoor) environment.
  • Amends the operating frequency band for Indoor Access Point to 5925 – 6425 MHz, which are capable of establishing a network, equipped with a routing mechanism between wired and wireless network segments, and providing a direct connection to the internet.
  • Amends the operating frequency band for Subordinate Access Point to 5925 – 6425 MHz, whose transmission is under the control of an Indoor Access Point, without a direct connection to the Internet, and not permitted to be used to connect devices between separate buildings or structures.
  • The RMS value of spurious emissions and any emissions outside the frequency band 5925 – 6425 MHz must be limited to a maximum EIRP spectral power density of -27 dBm/MHz.
  • The Act No. 10.400 enters into force on the date of its publication in the Anatel Electronic Service Bulletin, with the obligation for its implementation commencing on 1 March 2027.

Impact on Brazil Type Approval

Changes to the Wi-Fi 6 GHz frequency band in Brazil to 5925 – 6425 MHz presents specific challenges for manufacturers and certificate holders, particularly for Wi-Fi devices previously certified under the frequency band 5925 – 7125 MHz. Therefore, it is important for manufacturers and certificate holders to exercise careful checks when renewing the ANTEL certificates for their Wi-Fi devices following the implementation of the Act No. 10.400.

Wi-Fi devices supporting the 6 GHz frequency band must meet configuration requirements that restrict operation solely to the frequency band of 5925 – 6425 MHz. The process of adjusting the configuration of these Wi-Fi devices may begin prior to the 1 March 2027 deadline, when the Act No. 10.400 enters into force.
